Seasonal worker in the agricultural sector

If the non-European national comes here to work as a seasonal worker in the agricultural sector, the type of authorisation varies according to the employment period in Belgium.

Conditions to be met

In all cases, the employer has to meet the following conditions:

  • obtaining the appropriate authorisation to work;
  • paying the seasonal worker’s round trip travel costs, from their place of origin to their place of work;
  • taking out and paying for health insurance for the seasonal worker;
  • employing one or more non-European seasonal worker(s) for 5 months a year at most.

Apply for an authorisation to work

The seasonal worker will work in Belgium, in the agricultural sector, for more than 90 days and for 5 months at most.

If the person is living in Belgium:

Apply for a single permit

The authorisation to work is granted for the duration of the employment contract, with a maximum duration of 5 months. 

If the person is not living in Belgium (cross-border commuter):

Apply for a long-term authorisation to work

The authorisation to work is granted for the duration of the employment contract, with a maximum duration of 5 months 

The seasonal worker will work in Belgium, in the agricultural sector, for 90 days at most.

(Staying in Belgium/cross-border commuter)

Apply for a short-term authorisation to work

In case of successive jobs without any interruption, the previous periods are taken into account to calculate the 90 days. If the 90 days are exceeded, see procedure single permit.
