Provision of services (company EEA)
In the following case, in implementation of the Services Directive (Vander Elst), no action needs to be taken with Brussels Economy and Employment.
(Art. 18, §1, 2nd paragraph DBCR 16 May 2024)
The worker is employed by a company established in a member state of the European Economic Area. They are coming to Belgium to provide services.
You do not need to ask Brussels Economy and Employment for an authorisation to work in Belgium (Automatic exemption without time limitation if the following conditions are met).
Conditions
- The worker has the right or authorisation to stay for more than three months in their country of residence (Member State of the European Economic Area).
- The worker is legally authorised to work in their country of residence, and this authorisation is valid at least for the duration of the work to be carried out in Belgium.
- The employee has a lawful employment contract.
- The worker has a passport and a residence permit valid for at least the duration of the service to be provided.
