Single permit for long-term mobility
Temporary intra-group transfer (ICT)
1) For a first application
- The application form for an authorisation to work for a foreign worker (employer in Belgium or abroad), completed, signed and dated by the employer or their agent (natural person legally residing in Belgium), or generated by the electronic platform
- A photocopy of every page of the worker's current passport
- A photocopy of the identity card of the employer or their agent
- A photocopy of the document covering the worker's stay, if they are living in Belgium
- If the application concerns a secondment: a declaration signed by the employer specifying the duration of the secondment and the employment and payment conditions during the secondment
- If the application concerns a secondment: a copy of the document issued by the foreign social security institution stating that that country's social security legislation continues to apply during residence in Belgium where an international agreement on social security exists or, in the absence of such an international agreement, a document from the Federal Public Service Social Security stating that the worker cannot be subject to Belgian social security
- If the application concerns a secondment and if the employer abroad is a legal entity: the name of the employer, its legal form and a copy of its articles of association as registered in accordance with the law of the state in which it is established. If they are not drawn up in French, Dutch or English, the articles of association have to be translated by a sworn translator or interpreter as referred to in Book V of Part 2 of the Judicial Code.
- Proof of payment of the fee (see residency law of 15 December 1980)
- If the worker is aged 18 or over, an extract of the police records or equivalent document, certified, issued by the country of origin or the country of last residence of the worker and dated less than six months ago, declaring that the worker has not been sentenced for crimes or common law offences. This document must be drawn up in French, Dutch, German or English. Any translation of it must be made by a sworn translator (see residency law dated 15 December 1980).
- A medical certificate dated less than 6 months ago, showing that the worker is not suffering from any of the diseases listed in the appendix of the law of 15 December 1980 (see residency law of 15 December 1980):
- diseases subject to quarantine as stated in the International Health Regulations of the World Health Organisation, signed in Geneva on 23 May 2005;
- active or progressive tuberculosis of the respiratory tract;
- other infectious diseases or contagious parasitic diseases if, in Belgium, they are the subject of protection provisions applying to nationals.
- A model is available on the website of the Immigration Office.
- A commitment from the employer that the worker has health insurance covering all the risks in Belgium to themselves and members of their family (see residency law of 15 December 1980)
- A photocopy of the employment contract binding a person being transferred within a group (with at least 6 months’ service) to their employer abroad, to which will be attached the version translated by a sworn translator, where applicable
- Proof that the company established in a third country and the host company belong to the same parent corporation or business group
- For an executive/expert: A copy of the engagement letter, signed by the employer, specifying the duration of the transfer and the position held, as well as the working conditions and remuneration for the duration of the transfer. If applicable, the version translated by a sworn translator should be attached
For a trainee: A copy of the internship agreement, specifying the duration of the transfer and the training programme, as well as the working conditions and remuneration for the duration of the transfer. If applicable, the version translated by a sworn translator should be attached
The gross monthly salary will be at least the minimum amount required for an executive, expert or trainee, as the case may be. - A valid permit for a person being transferred within a group, issued by another member state.
