Appeal
If an enterprise counter refuses a registration (modification) application on the grounds that professional skills have not been demonstrated, the company can appeal against the decision to the Conseil d'Etablissement (Council of Establishments). This must be done within 30 days of notification of the refusal decision by the counter.
The appeal is signed by the applicant and sent by registered mail to the following address:
Brussels Economy and Employment - Service Economie, Conseil d'Etablissement - Place Saint-Lazare 2 - 1035 Bruxelles
The Conseil d'Etablissement is an administrative court composed as follows:
- the chairman (a magistrate or a lawyer);
- two assessors representing the Minister of Economy;
- one assessor representing the middle classes
The clerk summons the parties at least eight days before the hearing. The files may be consulted by the persons lodging an appeal or their representatives from the time of the summons to the hearing. The Conseil d'Etablissement can take all measures to inform itself, including questioning witnesses. The Conseil d'Etablissement deliberates in camera, decides by majority vote and announces its decision within 60 days of the appeal being lodged.
